Nella mattinata del 19 Febbraio 2022, i Carabinieri della Compagnia di San Giovanni Rotondo hanno proceduto alla sospensione temporanea della licenza ed alla chiusura di un bar di San Marco in Lamis, per giorni trenta.
Il provvedimento amministrativo in questione è stato richiesto dai Carabinieri della Compagnia di San Giovanni Rotondo, a seguito di una recente operazione antidroga eseguita lo scorso mese di gennaio sul territorio garganico. La Questura foggiana, valutati gli elementi posti a sostegno della richiesta dell’Arma dei Carabinieri e condividendone gli intenti, ne ha disposto quindi la chiusura immediata.
I motivi di pubblica sicurezza per cui la licenza di tale locale è stata temporaneamente sospesa sono riconducibili, secondo l’istruttoria amministrativa sviluppata, all’operazione antidroga in questione, in cui vennero in particolare tratte in arresto dieci persone, sei delle quali residenti proprio a San Marco in Lamis.
Nell’ordinanza di custodia cautelare che ne disponeva gli arresti, l’esercizio pubblico in questione, ubicato in pieno centro cittadino, veniva indicato come luogo principale degli incontri tra pusher ed acquirenti, nonché di cessione delle sostanze stupefacenti.
Questo è quanto emerso dalle copiose attività investigative svolte dell’ Arma dei Carabinieri durante la fase delle indagini preliminari, che hanno proceduto all’installazione di sistemi di video sorveglianza proprio nei pressi di quell’attività, utili a rilevare l’attività criminosa di spaccio.
Tale assunto alla base del quale è stato emesso il provvedimento di sospensione in menzione rientra in quelle che sono le regole dell’art. 100 TULPS, che da appunto la possibilità al Questore, quale Autorità Provinciale di Pubblica Sicurezza, di poter sospendere la licenza di un esercizio nel quale siano avvenuti tumulti o gravi disordini, o che sia abituale ritrovo di persone pregiudicate e pericolose, o che, comunque, costituisca un pericolo per l’ordine pubblico, per la moralità e il buon costume o per la sicurezza dei cittadini.
Il provvedimento eseguito deve avere il compito di ripristinare la legalità in un esercizio pubblico, al fine di evitare che in futuro episodi come quelli accertati possano ripetersi.
